San Jose, California, is set to become the first city in the United States to enact legislation requiring most gun owners to pay a fee and carry liability insurance.

San Jose Mayor Sam Liccardo said in a statement Tuesday night that the city council had voted in favor of both measures, which are aimed at reducing the risk of gun violence and relieving taxpayers of the financial cost of gun violence.

Despite opposition from gun owners who claimed the measures violated their Second Amendment rights and threatened to sue, the council overwhelmingly approved the measures. The ordinance must still pass a final reading next month before it can go into effect in Silicon Valley city in August.

The fees paid by gun owners will be used to fund “evidence-based initiatives to reduce gun violence and gun harm,” according to Liccardo. According to NBC News San Diego, the fee is expected to be around $25.

Meanwhile, having liability insurance is intended to encourage San Jose gun owners to take safety precautions such as having gun safes, installing trigger locks, and taking gun safety classes.

Gun owners who do not obtain insurance, on the other hand, will not lose their firearms or face criminal charges under the new rules.

“I’d like to thank my council colleagues for their continued commitment to reducing gun violence and its devastation in our community,” Liccardo said.

The new measures, he claims, will contribute to the development of a “constitutionally compliant path to mitigating the unnecessary suffering from gun harm in our community.”

Liccardo first proposed the measures in June, nearly two weeks after a gunman fatally shot nine coworkers at a San Jose light rail yard before killing himself in a national headline-grabbing incident.

While the mayor of San Jose celebrated Tuesday’s election, not everyone was pleased with the outcome.

Prior to the vote, Sam Paredes, executive director of Gun Owners of California, stated that his organization would sue if the proposal became law. According to NBC San Diego, he called it “totally unconstitutional in any configuration.”

Attorneys have already volunteered to defend the city pro bono if legal action is taken in response to the new rules, according to Liccardo.
